This is a legal agreement between you, the individual or entity accessing, viewing, or using the content and features available within the Paisa Monitor mobile application (“App”) (referred to in this document as “you,” “your,” or “User”) and Paisa Monitor, the Proprietorship firm (referred to as “we,” “our,” or “us”).
These terms and conditions (“Terms”) set forth the legally binding terms for your use of the App and any other related platforms or digital services that we may provide in the future, including but not limited to associated websites, software, and services offered in connection with the App (collectively referred to as “Services”). These Terms apply to all Users, regardless of whether they are using free or paid features within the App.
Paisa Monitor is a digital tool designed to help retail shops generate receipts, track daily expenses, and manage sales records efficiently.
By downloading, registering, accessing, or using any part of the App or our Services, you agree to be bound by all the terms outlined in this document. Your use of the App is also governed by our Privacy Policy, which is incorporated herein by reference, along with any additional terms and conditions that may be communicated to you from time to time. These may include service-specific guidelines, payment policies, or usage rules, all of which will form part of these Terms once made available.
Please read these Terms carefully before using the App. If you do not agree with any part of these Terms or the Privacy Policy, you must not use the App or the Services.
1. SUBSCRIPTION OF SERVICE
Paisa Monitor is a mobile application designed to help retail shop owners and small businesses manage their daily operations with ease. The App enables users to create receipts, track daily expenses, and manage sales records. These features and related services (collectively referred to as “Services”) are offered and operated by us.
The Services are intended solely for your personal or business use in managing and maintaining retail records. By subscribing to or using any feature within the App, you agree to abide by these Terms.
Subscription Terms
Your subscription to any of the App’s Services is subject to the following terms and conditions:
Access: A subscription gives you access only to the specific functionalities and content available under the plan or tier you subscribed to. We may, at our discretion, introduce additional features or enhancements, which may be free or chargeable. Access to such additions is not automatically included with your subscription.
License: You are granted a limited, non-exclusive, non-transferable license to access and use the App and its Services during your active subscription period. You may not share, assign, resell, or transfer your access to anyone else.
Validity: Subscription plans are valid for a specific period (e.g., monthly or annually) as mentioned at the time of purchase. After the subscription period ends, your access to the App’s premium features will be restricted unless renewed.
Package Variations: We may offer different subscription plans or pricing models to different users, including promotional offers. These offerings may vary and are solely at our discretion.
Cancellation of Subscription: You may cancel your subscription at any time by contacting us via the contact information provided within the App or our support email. Upon cancellation, access to subscription-based features will continue until the end of your current billing cycle. No refunds will be provided for the remaining duration unless required by applicable law.
2. REGISTRATION OF USER
To access and use the features of Paisa Monitor, especially subscription-based or personalized functionalities, you may be required to register by providing details such as your name, mobile number, email address, and other requested information. By registering, you represent and warrant that all information provided by you is accurate, complete, and not misleading.
You agree to the following:
· You will not register with false or misleading information.
· You will not create an account on behalf of another individual or business without appropriate authorization.
· You will not use any offensive, vulgar, or unlawful identifiers in your profile or account.
· You will not share your login credentials or allow others to access your account, especially for commercial or malicious purposes.
· You will not use your credentials to attempt to disrupt the App’s operation, breach its security, or access unauthorized areas.
· If you are an individual, you confirm that you are of legal age to enter into a binding contract under applicable laws. If you are under the legal age, you may use and register on the App only under the supervision and consent of a parent or legal guardian. We reserve the right to suspend or terminate your access if we become aware that this requirement is not met.
· You are solely responsible for all activity carried out through your account and for maintaining the confidentiality of your login credentials. In case of any suspected unauthorized access or security breach, you must notify us immediately.
3. USER CONDUCT AND GUIDELINES
Users are expected to uphold a high standard of decorum, decency, and integrity while using the Paisa Monitor App and Services.
You acknowledge and agree to the following:
Respectful Interactions: You will engage respectfully, professionally, and inclusively in all your interactions and communications on the App, Services, and any platform where Paisa Monitor may facilitate discussions.
Appropriate Communication: Any communication made by you on this App or any platform connected with the Services of Paisa Monitor must not be harmful, harassing, defamatory, pornographic, invasive of another’s privacy, hateful, disparaging, or illegal. This includes refraining from communication that is blasphemous, injurious to third parties, racially or ethnically objectionable, or objectionable on political, religious, or sexual grounds.
Protection of Minors: You will not communicate or behave in a manner that is harmful to minors in any way.
Intellectual Property: You will not reproduce, distribute, or use any part of the App or Services for commercial purposes or otherwise, through any medium, without the express written consent of us.
Integrity of Technology: You will not tamper with, alter, or modify any part of the App or the technology underlying the Services provided.
False Statements: You will not make false, misleading, or malicious statements about the App or Services offered by Paisa Monitor.
Lawful Use: You will use the App and Services only in compliance with all applicable laws, and not for any unlawful or unethical activity. This includes refraining from hacking, inserting malicious code, or engaging in any disruptive behaviour affecting the App, Services, or backend systems.
Avoiding Disruptive Behaviour: You will not engage in antisocial, disruptive, or destructive acts such as "flaming," "spamming," "flooding," "trolling," or "phishing" as commonly understood on the internet.
System Integrity: You will not use the App or Services in any way that could damage, disable, overburden, or impair the systems or security of Paisa Monitor, or interfere with other Users' experience.
Prohibition of Malicious Software: You will not release any virus, malware, or harmful code intended to interrupt or impair the functionality of any computer or mobile resource used by Paisa Monitor.
No Reverse Engineering: You will not carry out reverse engineering or attempt to extract the source code of any part of the App or its software components.
Legal Compliance: You will comply with all laws and regulations applicable to your use of the App, including data handling and privacy laws.
Respecting Third-Party Rights: You will not post or share any information belonging to a third party without proper authorization, and you will not violate any third-party intellectual property rights including copyrights, trademarks, or patents.
Truthful Communication: You will not deceive or mislead others about the origin of messages, nor communicate in a manner that is grossly offensive, intimidating, or threatening.
No Impersonation: You will not impersonate another person or falsely present your identity or association with any individual or entity.
No False Information: You will not post or share content that is false, untrue, or misleading with the intention to cause harm or obtain financial gain.
National Security: You will not act in a manner that threatens national unity, integrity, defense, or sovereignty, or that disrupts public order, incites an offense, or obstructs legal investigations.
4. PERSONAL INFORMATION AND DATA SECURITY
Please refer to our Privacy Policy to understand how your personal data is collected, used, shared, and protected by us.
We are committed to maintaining the confidentiality and integrity of your personal and business data. Your use of the App signifies your acceptance of the terms laid out in our Privacy Policy.
5. PRICING AND PAYMENT
You agree to pay all applicable fees and charges for the Services you choose to access or subscribe to through the Paisa Monitor App. All payments are due in full and in advance, and your access to the Services will remain valid until the end of your chosen billing cycle or until your subscription is cancelled or terminated, as outlined in these Terms.
We may offer a free trial period for new users. After the trial ends, continued access will require timely payment as per the pricing plan you select. If you fail to make the required payment, your access to the Services may be suspended or terminated without prior notice.
Payments are processed through third-party payment gateways or aggregators (“Third-Party Payment Service Providers”). These providers operate independently and are not affiliated with Paisa Monitor.
If you are redirected to the website or application of a Third-Party Payment Service Provider, please note that:
· We are not responsible for the security or privacy of any information you submit on those platforms;
· We do not control the security practices or terms of use of those providers;
· We are not liable for any interactions, correspondence, or transactions that occur between you and the Third-Party Payment Service Providers.
· We strongly encourage you to carefully read the terms, privacy policies, and other relevant documents provided by the Third-Party Payment Service Providers before proceeding with your transaction.
6. INTELLECTUAL PROPERTY RIGHTS
At Paisa Monitor, we take great pride in the functionality, originality, and design of the App and all Content made available through our Services. This Content is protected by various intellectual property laws, including copyright, trademark, trade secret, and other proprietary rights.
All elements of the App—including its interface, design, features, functionalities, text, graphics, code, and layout—are either exclusively owned by us, or used with proper authorization or licensing. Any trademarks, service marks, or trade names featured within the App are the sole property of their respective owners and are protected accordingly.
By using the App, you agree to:
· Avoid Reproduction: You will not copy, reproduce, republish, upload, post, transmit, or distribute any portion of the App or its Content without our prior written permission.
· Respect the Platform: You will not use, store, display, or modify any part of the App in a way that breaches these Terms.
· Preserve Integrity: You will not alter, remove, or tamper with copyright notices, trademarks, logos, or any proprietary markings you do not own or have permission to edit.
· No Reverse Engineering: You will not decompile, disassemble, or reverse engineer any software or technology used in the App.
· You are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to use the App and its features solely for your personal, non-commercial use. Any other usage or distribution is strictly prohibited unless explicitly permitted by us.
· The App may also contain content or data submitted by third parties. While we strive to provide a secure and seamless experience, we do not guarantee the authenticity or accuracy of such third-party content. By accessing or interacting with this content, you acknowledge that you do so at your own risk.
· If you submit any content or feedback through the App, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, display, and distribute such content as necessary to provide and improve the Services.
7. INDEMNITY
By accessing and using the Paisa Monitor App and its Services, you agree to defend, indemnify, and hold harmless tous, along with any affiliates, agents, or partners, from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) that may arise from:
a. Your use or misuse of the App or its Services;
b. Any breach of these Terms and Conditions;
c. Any violation of intellectual property rights or other rights of the Paisa Monitor or third parties;
d. Any issues or disputes arising from your use of Third-Party Payment Service Providers in connection with the App.
Please note that the we are not responsible for any actions, errors, or omissions by any Third-Party Payment Service Providers. These services operate independently and are governed by their own terms and policies.
In case we choose to take full control over the defence of any claim for which you are liable to provide indemnification, you agree to fully cooperate and assist in the defence process, including asserting all available legal defences.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Paisa Monitor along with any associated partners or agents, expressly disclaims and excludes all liability for any direct, indirect, incidental, special, punitive, or consequential losses or damages arising from:
· Your use of the App, its Services, or any associated Content;
· Your use of third-party content or interactions with third-party service providers;
· Any unauthorized access to or use of secure servers or user data.
We are not liable for:
· Any interruption, unavailability, or discontinuation of the App or Services due to reasons beyond our reasonable control, including events of force majeure;
· Any mismatch between your expectations and the actual performance or outcome of the App or Services. It is your responsibility to assess whether the App suits your individual needs before using it.
This limitation of liability does not affect any of your indemnity obligations stated in these Terms.
Furthermore, We, along with any supporting agents, is not personally liable for any actions or outcomes related to your use of the App or its Services.
9. TERMINATION OF SERVICES / DELETION OF ACCOUNT
We reserve the right to terminate or suspend your access to the Paisa Monitor App and its Services at any time and with immediate effect if you are found to be in violation of these Terms and Conditions.
Please note that:
· Any payments, subscriptions, or charges made prior to termination will remain non-refundable, regardless of the reason for termination.
· Upon termination, certain clauses in these Terms—such as ownership rights, indemnity, and limitation of liability—shall continue to remain in effect.
· We may also, at our sole discretion, remove or disable access to any data, activity, or content that we consider unlawful, harmful, or in violation of our policies.
· If you wish to voluntarily delete your account or discontinue the use of our Services, you may do so by contacting us through the support options available within the App. Please be aware that account deletion is permanent, and you may lose all data stored in the App unless you have exported or backed it up prior to deletion.
10. MODIFICATION OF TERMS OF USE
We reserve the right, at our sole discretion, to modify, update, or replace any part of these Terms, or to change, suspend, or discontinue any aspect of the App or its Services, with appropriate notice to you by email.
We may also impose limitations on certain features or restrict access to parts of the App without prior notice or liability.
It is your responsibility to periodically review these Terms for any updates. Your continued use of the App and its Services after any such changes are posted will constitute your acceptance of those modifications.
11. DISCLAIMERS
The Paisa Monitor App and its Services may occasionally experience downtime due to scheduled maintenance, technical issues, or other unforeseen problems. Additionally, certain content or features may contain errors or become temporarily unavailable.
By using the App, you acknowledge and agree that such issues may occur, and you waive any claim against us, for any resulting inconvenience, loss, or damages.
The App and all associated Services are provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, including but not limited to:
· The accuracy, reliability, or availability of the App or its Services;
· Fitness for a particular purpose or merchantability;
· Security, error-free operation, or uninterrupted access;
· Achievement of specific results or outcomes from using the App.
You use the App entirely at your own risk. We may discontinue or modify any part of the App or its features at any time for any reason. Under no circumstances shall the Paisa Monitor, or any related agents, be held liable for any losses or damages caused by such changes or unavailability.
We are also not responsible for delays or failures in performance due to events beyond our control, including natural disasters, war, government actions, technical failures, or internet disruptions.
12. NO AGENCY OR PARTNERSHIP
Nothing in these Terms shall be construed to create any agency, partnership, joint venture, employment, or contractor relationship between you and Paisa Monitor.
You acknowledge that you are using the App independently, and no such legal relationship exists between you and Paisa Monitor.
13. LEGAL ACTIONS AND NOTICES
No legal action related to these Terms or your use of the App may be initiated by either party more than one year after the cause of action arises, unless otherwise required by applicable law.
Any notice or legal communication under these Terms must be provided in writing. Notices may be sent via:

14. DISPUTE RESOLUTION
In the event of a dispute, our Support Team is here to help you resolve any issues. If our informal resolution doesn’t work and you’re based in India, you have the option to address your concerns through court or binding individual arbitration. Note that you cannot bring a claim in another court or participate in a class action. This section, known as the “Dispute Resolution Agreement,” applies only if you reside in India. Most issues can be resolved amicably, so we encourage you to first contact our Support Team.
14.1 Dispute Resolution Overview
We aim to resolve disputes with our users without resorting to formal legal proceedings. If a disagreement arises, you and Paisa Monitor agree to make every effort to resolve it fairly and in good faith through the informal dispute resolution process outlined below. If necessary, a third party may assist in resolving the issue. This agreement outlines how disputes must be addressed.
YOU AND PAISA MONITOR AGREE THAT ANY DISPUTES, CLAIMS, OR CONTROVERSIES ARISING FROM THESE TERMS, INCLUDING THEIR APPLICABILITY, BREACH, TERMINATION, VALIDITY, ENFORCEMENT, INTERPRETATION, OR USE OF THE SERVICES, MUST BE RESOLVED EXCLUSIVELY THROUGH COURT OR BINDING INDIVIDUAL ARBITRATION. BOTH PARTIES AGREE TO BRING CLAIMS ONLY IN THEIR INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS OR REPRESENTATIVE PROCEEDING. THIS AGREEMENT APPLIES TO ALL PARTIES INCLUDING THEIR AGENTS, ATTORNEYS, CONTRACTORS, AND EMPLOYEES.
14.2 Mandatory Informal Dispute Resolution Process
Before pursuing any formal claim, you and Paisa Monitor must engage in the informal dispute resolution process:
The party initiating the claim must send a brief written statement (“Claim Statement”) to the other party, including their full name, mailing address, email address, the nature of the dispute, and a proposal for resolution (including any monetary claims and calculations).
Send your Claim Statement to us by email at support@paisamonitor.in or by certified mail to our registered address. We will respond to you at the email address associated with your account unless you request otherwise.
Upon receiving a Claim Statement, both parties will attempt to resolve the issue informally within 60 days. If resolution is not achieved within this period, either party may initiate formal proceedings in court or arbitration as per this Dispute Resolution Agreement.
Failure to complete this informal dispute resolution process is considered a material breach of these Terms, and no court or arbitrator will have jurisdiction to hear any disputes.
14.3 Arbitration
As an alternative to court, disputes can be resolved through individual arbitration. Although arbitration doesn’t involve a judge or jury, the arbitrator has the authority to award individual relief and must adhere to our agreement just as a court would. If a dispute is filed in court, the other party can request that the matter be moved to arbitration. Arbitration proceedings will pause any court actions pending the resolution of arbitrable issues.
If there’s a disagreement over whether a dispute should be arbitrated or about the scope of the arbitrator’s powers, the arbitrator alone will address these issues. This provision does not limit the ability to challenge an improperly initiated arbitration.
Courts have the authority to enforce this Dispute Resolution Agreement and to prevent any arbitration or mediation that doesn’t comply with it.
14.4 Fees and Costs
Each party will bear its own costs and attorney’s fees in a dispute, except as permitted by law. If a court or arbitrator finds that arbitration was initiated in bad faith or for an improper purpose, they may award attorney’s fees to the defending party, similar to a court ruling.
15. APPLICABLE LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India. For the purposes of these Terms, you consent to the courts of Malvan, Maharaashtra having exclusive jurisdiction over any and all disputes that arise out of, or in relation to or connected with these Terms.
16. GRIEVANCE REDRESSAL AND GRIEVANCE OFFICER
If you have any queries or complaints, please reach out to our Grievance Officer. The Grievance Officer will acknowledge your complaint within 24 hours of receipt. We are committed to addressing your complaint and will make every effort to resolve it within 15 days from the date it is received.
